4.2 Nature of Services

You understand and agree that:

  • Our screening tools are designed for educational purposes and are not a substitute for professional medical or psychological diagnosis
  • Results should be used as part of a comprehensive educational assessment
  • We continuously improve our Services based on research and user feedback
  • Service availability may vary and we may modify or discontinue features

5. Subscriptions & Payments

5.1 Free and Paid Services

We offer both free and paid subscription plans. The free plan includes basic features, while paid plans offer enhanced functionality.

5.2 Subscription Terms

For paid subscriptions:

  • Fees are billed in advance on a monthly or annual basis
  • Automatic renewal unless canceled before the renewal date
  • Price changes will be communicated with 30 days' notice
  • All fees are non-refundable except as required by law

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

5.4 Third-Party Payment Processing

All payments are processed by third-party payment processors. You agree to their terms and conditions and acknowledge that we do not store your payment card information.

No Guarantee of Results: While our Services are based on scientific research, we cannot guarantee specific educational outcomes or that our screening will identify all cases of dyslexia.

10. Limitation of Liability

To the fullest extent permitted by law, Logifera and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services
  • Any conduct or content of any third party on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability to you for all claims arising out of or relating to these Terms or your use of the Services shall not exceed the amount you have paid to us in the past twelve months.

11. Termination

11.1 By You

You may stop using our Services at any time. You may also delete your account through your account settings.

11.2 By Us

We may suspend or terminate your access to the Services if you violate these Terms or for any other reason at our discretion. We will provide notice when reasonably possible.

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

12. Dispute Resolution

These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.

12.2 Informal Resolution

We prefer to resolve disputes informally. Before filing a claim, you agree to try to resolve the dispute by contacting us at legal@logifera.com.

12.3 Binding Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in San Francisco, California, rather than in court.

12.4 Class Action Waiver

You may only resolve disputes with us on an individual basis and may not bring a claim as a plaintiff or class member in a class or representative action.

13. Changes to Terms

We may modify these Terms from time to time. If we make changes, we will provide notice through our Services or by other means. Your continued use of the Services after the changes become effective constitutes acceptance of the revised Terms.

If you do not agree to the modified Terms, you should discontinue your use of our Services.
